Access to the Services

The Bistail website, platform, content, features, and any related services are owned and operated by Bistail.

This does not transfer ownership of your materials to Bistail. You remain responsible for the accuracy, legality, and rights related to any materials you submit.

Restrictions

You agree not to use Bistail services in any way that:

• infringes intellectual property, privacy, publicity, or proprietary rights;
• is fraudulent, misleading, abusive, harmful, defamatory, obscene, or otherwise inappropriate;

• attempts to gain unauthorized access to accounts, systems, networks, or data;
• interferes with the proper operation of the website, platform, or services;
• places unreasonable load on Bistail infrastructure;

Bistail does not guarantee that the services will be uninterrupted, error-free, secure, or free from defects. Bistail also does not guarantee specific campaign results, performance outcomes, traffic quality, conversions, revenue, or business results unless expressly agreed in a separate written agreement.

To the fullest extent permitted by law, Bistail disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.

Limitation of Liability

To the fullest extent permitted by applicable law, Bistail shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, revenue, data, business opportunities, goodwill, or cost of substitute services.

Bistail shall not be responsible for any matter outside its reasonable control, including technical failures, internet outages, third-party service issues, cyber incidents, force majeure events, or actions of external partners.

Any liability that cannot be excluded under applicable law shall be limited to the maximum extent permitted by law.

Indemnity

Nothing in these Terms creates a partnership, joint venture, agency, employment relationship, or franchise between you and Bistail.

These Terms shall be governed by the laws and jurisdiction determined by Bistail’s corporate registration and applicable commercial agreements.

If a separate written agreement exists between Bistail and a customer or partner, that agreement may define the applicable governing law, dispute resolution process, and jurisdiction.
